Breakthrough Device CMS Coverage - Is It All Good News?

Insight from Matt Tucker

I am thrilled to give you my thoughts about the recently introduced legislation, the Ensuring Patient Access to Critical Breakthrough Products Act of 2023. This bill has the potential to revolutionize healthcare by providing faster access to breakthrough medical devices for Medicare beneficiaries. While this is undoubtedly a positive step towards improving patient care, it is also essential to consider the potential risks associated with the legislation.

Here are four points to consider:

Good:

  • Supports innovation in medical products - The Ensuring Patient Access to Critical Breakthrough Products Act of 2023 is a vital step in supporting innovation in the medical device industry. By streamlining the approval process for breakthrough medical devices, the bill could provide companies with greater confidence in their investments and encourage them to take risks in developing new and innovative products. This, in turn, could accelerate the pace of innovation, ultimately resulting in better patient outcomes and more affordable healthcare for everyone.
  • Gives patients access to needed therapies - By providing Medicare beneficiaries with access to breakthrough medical devices, the bill could improve the quality of life for millions of seniors who may not have had access to these devices otherwise. This could lead to better health outcomes and reduced healthcare costs in the long run, ultimately benefiting everyone.

Not so good:

  • Restricts therapies to only older adults - One potential downside of the Ensuring Patient Access to Critical Breakthrough Products Act of 2023 is that it only applies to Medicare beneficiaries who are 65 years or older. This leaves out younger patients who may also desperately need breakthrough medical devices, potentially creating disparities in access to care and leaving certain patient populations without access to these innovative treatments.
  • Accelerates adoption of untested products - Another potential downside of the bill is that it could lead to the accelerated adoption of breakthrough medical devices that haven't been fully tested and warrant such broad coverage. This could pose risks to patient safety and could lead to unnecessary healthcare costs if the devices do not work as intended. While the bill aims to improve patient care, it is essential to ensure that patient safety is not compromised in the process.

The Ensuring Patient Access to Critical Breakthrough Products Act of 2023 has the potential to improve patient care by providing faster access to breakthrough medical devices. However, it is essential to consider the potential risks associated with the bill, particularly in terms of patient safety and access to care. On balance, the legislation is a positive step towards improving healthcare outcomes for seniors, but it must be implemented with caution to ensure that everyone benefits. I am excited to see how this legislation will impact the future of healthcare and look forward to continued progress in this area.

Device and Device Company Failures Are Good.

Insight from Matt Tucker

In the fast-paced world of medical device innovation, there is a notion that many companies and their devices are destined to fail. And guess what?

That's a good thing.

Innovation in the medical device industry has always been a challenging feat. It is a high-stakes, high-risk industry that requires significant investment and resources to bring a product to market. Despite this, many companies try their luck in this space, hoping to make a big splash with a groundbreaking device that will change the world. However, the harsh reality is that not all of them will succeed.

While it may seem cruel or unfair that so many medical device companies are destined to fail, the truth is that this is an essential part of the innovation process. In fact, it's what makes the industry so dynamic, competitive, and ultimately successful. The concept of 'survival of the fittest' applies to the medical device industry just as much as it does to the natural world.

The truth is that not all medical device innovations are created equal. Some will be groundbreaking, while others will be merely mediocre. Some will solve a significant unmet need, while others will fail to gain traction in the market. And that's okay.

As harsh as it may sound, the failure of some companies and their devices is actually a good thing. Failure weeds out the weak and unproductive, leaving only the best and most innovative companies to thrive. This is the nature of the medical device industry, and it's what makes it so exciting and dynamic.

Some may argue that failure is a negative thing, and that every company and device deserves a chance to succeed. But the reality is that the medical device industry is not a charity. It's a business, and like any business, it must be efficient, competitive, and profitable to survive.

Of course, this doesn't mean that we should celebrate the failure of companies or their employees. Nobody wants to see people lose their jobs or suffer financial hardship. But we should recognize that failure is an inherent part of the innovation process and that it is necessary for the industry's continued growth and success.

So, should lots of medical device companies and their products fail? Absolutely. It's what makes the industry so dynamic, competitive, and ultimately successful. Without failure, there can be no progress. And in the world of medical device innovation, progress is what we're all striving for.
